Labour Code very strictly regulates the conditions for entering into fixed-term employment relationships, which can be uncomfortably restrictive for the employer in certain situations. In order to ensure that this limitation is not absolute, the Labour Code introduces the possibility of exercising an exception to the statutory regulation of fixed-term employment relationships.
However, the employer must comply with the statutory a condition to capture the rules for a select group of employees who will be affected by the exemption, either in an internal regulation or in a written agreement with the trade union, if the trade union is active in the employer.
We recommend that due consideration be given to the drafting of the agreement, in particular the specification of the reasons for the exemption.
