Qualification is the overall ability of an employee to perform a specific job based on the employee's theoretical and practical experience and skills. Very often, both the employer and the employee have an interest in the employee gained more professional knowledge in his/her field or mastered new techniques. S both parties can already count on the deepening or improvement of qualifications at the time of the employment relationship.

As in many cases this is a time and money consuming programme, we recommend that employers clearly set out the rules for such training with their employees through a written qualification agreement.

Qualification Agreement Contains a commitment by an employee to remain in the employer's employment for a specified period of time. The maximum period of of this commitment is 5 years from the date of upgrading or deepening of the qualification. In the event of a breach of the employee's obligation, the following occurs the obligation to reimburse the employer for the costs incurred by the employer to increase or deepen his/her qualifications, or a pro rata part thereof (Section 234(1) of the Labour Code).
