However, you may not be aware that insolvency proceedings have been opened. In insolvency proceedings, everything is only published electronically in the insolvency register. No one informs you about changes in the insolvency register. The law favours the vigilant.
What happens if you do not file a claim in insolvency proceedings? It is very likely that you will lose your claim. Although there are some exceptions, you can only file a claim after the insolvency proceedings have been opened. There are certain effects associated with the opening of insolvency proceedings, e.g. the court proceedings are suspended and the debtor's property cannot be executed.
So what if I sign up? If you manage to file your claim in the insolvency proceedings on time, you can get at least some of your money back.
If the court approves the debtor's debt relief, will be resolved by monetising the debtor's assets or by instalment plan. The debtor must comply with the conditions throughout the insolvency proceedings. This is the only way the court can issue a exemption from outstanding and undeclared debts.
If the debtor's property is declared competition, will be resolved by the monetisation of the debtor's assets. In this case, however, you can send the debtor to foreclosure after the proceedings have been completed on the basis of the list of claims filed, without going through the court proceedings. In such a case, the list of claims is considered to be enforcement title.
